Naturalisation in the Czech Republic

Researcher: Mgr. Pavel Kandalec, Ph.D., LL.M.

Basic information:

While international law has maintained to date that naturalisation is an exclusive matter of every country, this principle has become increasingly eroded as a result of European Court of Human Rights and Court of Justice of the European Union case law. This project analyses the decisions of the Ministry of the Interior and, subsequently, administrative courts regarding naturalisation in the Czech Republic. The timing of the project has made it possible to observe the effects of the new Act on State Citizenship (effective from 1 January 2014) on the decision-making practice and make a comparison with existing practice. Analysis has been done of all naturalisation rejection decisions issued in the years 2013-2016 and all eventual subsequent appeals.

This project has been funded by GAČR - Czech Science Foundation (GA15-07626S).
